(c) TDS encourages me to periodically review these documents to stay informed of any changes. Such changes will take effect immediately, unless applicable law requires notice; in this case, the change will take effect at the end of the required notice period. On the effective date of any changes to any of these documents, my continued use of the Services constitutes my acceptance of such change and my agreement to be bound by the terms of the document as amended. If I do not agree to such a change, I will immediately stop using the Services and notify TDS that I am terminating my Service Account. (a) This Agreement, the Work Order, the Acceptable Use Policy and all effective and applicable rates, any of which may modify TDS as set forth below, constitute the entire agreement between TDS and me. This Agreement supersedes all prior written or oral agreements between TDS and myself. I have no right to rely on oral or written statements made by representatives of TDS with respect to the matters covered by these documents, whether made before or after the date of my work order, and TDS will not be liable to me except with respect to its obligations as described in this Agreement and the other documents set forth above. Use of my Services by anyone other than me is also subject to the terms of this Agreement, the Acceptable Use Policy and all applicable rates. h) Responsibility of the broadband data provider. TDS (including any Internet service provider that TDS engages to provide my data service) is responsible for the high-speed data service. I acknowledge that TDS (including any Internet service provider that TDS engages to provide my data service) may have one or more separate agreements, policies or other terms that cover my rights and obligations with respect to the high-speed data service and that are also binding on me. This Agreement does not obliate TDS to enter into any relationship or obligation with the features or services of an Internet service provider or online provider otherwise made available to me by an Internet service provider or online provider through the TDS High Speed Data Service.

In the event of termination of the broadband data service, I must also contact my Internet service provider or online provider to ensure that these other features or services (e.B remote access) are properly continued or interrupted. This Agreement is governed by applicable laws and regulations and all applicable franchise agreements between a government agency and TDS, except as expressly provided in Section 15. « Arbitration ». In the event that any part of this Agreement is held to be invalid or unenforceable, the invalid or unenforceable part shall be construed in accordance with applicable law to the fullest extent possible to reflect the original intentions of the parties as set forth herein, and the remainder of this Agreement shall remain in full force and effect. (a) I agree that TDS has the right to supplement, modify or remove any aspect, feature or requirement of the Services (including content, price, equipment and system requirements). If TDS changes its equipment requirements with respect to services, I acknowledge that I may not be able to receive such services with my current equipment. In the event of such a change, my continued use of the Services constitutes my acceptance of such change and my agreement to continue to receive the applicable Services in the form so modified in accordance with this Agreement, the Acceptable Use Policy and applicable price lists or rates. If I participate in a promotional offer for one or more Services that cover a certain period of time, I agree to pay the promotional price for those Services during the specified period and to pay the normal fees for the Services after the specified period. I agree that TDS has the right to supplement, modify or remove any aspect, feature or requirement of the relevant services during this promotional period, except for the price charged to me. This Agreement contains the entire agreement between the parties with respect to the rights granted herein and the obligations assumed herein and supersedes all prior written or oral agreements or communications between the parties. 36. Force Majeure. (a) Network speeds and management. I acknowledge that each level or level of high-speed data service has limits on the maximum speed at which I can send and receive data at any time, as set out in the price list or acceptable use policy or a specific contract with TDS. The maximum speed at which I send and receive data can be achieved in bursts, but is generally not maintained consistently due to the nature of the Internet, the protocols used to transmit data to and from the Internet, and TDS facilities.

I understand that the actual speeds I may experience at any given time vary due to a number of factors, including the capabilities of my computer, the cabling at my location, the time I use the service, Internet congestion, the technical characteristics of the websites, the content and applications I access, and the network management techniques used by TDS. I agree that TDS (including any Internet service provider that TDS engages to provide my Internet Service) may change the speed of a level by changing the price list or terms of use and giving notice as described in this Agreement. My continued use of the high-speed data service after such notification represents my acceptance of any new speed. I also agree that TDS may use technical means or tools, including but not limited to suspending or reducing the speed of my high-speed data service, to ensure compliance with its terms of use and to ensure that its service operates effectively. I further agree that TDS (including any Internet service provider that TDS engages to provide my data service) has the right to monitor my bandwidth usage patterns in order to facilitate the provision of the high-speed data service and to ensure my compliance with the Terms of Use and to effectively manage its network and the provision of services. TDS (including any Internet service provider that TDS engages to provide my data service) may take such action as it deems appropriate if my use of the high-speed data service does not comply with the acceptable use guidelines. I acknowledge that the High Speed Data Service does not include any other services managed by TDS and provided through the TDS shared infrastructure, including the Video Service and the Voice Service. A seller of the property can claim the SDS deducted at the time of filing their tax return for a property. In the event that a refund is made on the basis of TDS when selling a property, the refund can be requested through an ITR deposit. In principle, anyone responsible for the TDS deduction must purchase a TAN (Tax Withdrawal Account Number).
